Yellow Point Collekt Art Services (referred to as “Company,” “us” or “we”), takes your privacy seriously. This Policy discloses the privacy practices for the Company’s app (referred to as the “App”), website (referred to as the “Site”) as well as related products and services we may offer to you (collectively referred to as the “Services”). This policy covers what personal information we receive or collect from our users, and how that personal information is used.

We reserve the right to change this Privacy Policy from time to time. We will notify you about significant changes to the way in which we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and by updating any privacy information on this page. Your continued use of the App and or Services after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) your agreement to abide and be bound by that Policy.

By using the app, you give your consent that all personal data that you submit may be processed in the manner and for the purposes described below. If you do not agree to these terms and conditions, do not use the App, Site, or any Services.

Information Collection and Use

In order to provide our App and Services, some personal information is collected and used.

General

For a better user experience, while using our App or other Services, we may require you to provide us with certain personally identifiable information, including but not limited to name, email address, mailing address, zip code, and telephone number. Once you register and sign in to our App or Services, you are not anonymous to us. We use this information for the following general purposes which may include: (a) registering for an account on our App; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting a form or transmitting other information by telephone or letter; (f) submitting your credit card or other payment information when ordering and purchasing appraisals and other services on our App; (g) customizing the advertising and content you see; (h) fulfilling  your requests for products and services; (i) improving our services; (j) contacting you; (k) and or conducting research.

When ordering products or services on the App, you may be asked to provide a credit card number. When uploading information about artwork on the App, you may be asked to optionally provide information about the artwork, artist, and its location.

Log Data

This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on our Site and what other sites may have directed you to us. This information, which is collected in a variety of different ways, is compiled and analyzed on both a personal and an aggregated basis. This information may include the Website’s Uniform Resource Locator (“URL”) that points to the site you just came from, which URL you go to after visiting our Site, what browser you are using, and your Internet Protocol (“IP”) address.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device’s internal memory.

This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

Third Party Services

The Site and or App does use third party services that may collect information used to identify you. Other Sites accessible through this Site, including our Advertising and Service Partners, have their own privacy policies and data collection, use and disclosure practices. Please consult each Site’s privacy policy. We are not responsible for the policies or practices of third parties.

Release of Information

We will not sell, trade, or rent your personally identifiable information to others. We do provide some of our product and service offerings through contractual arrangements made with affiliates, service providers, partners and other third parties (“Service Partners”). We and our Service Partners may need to use some personally identifiable information in order to perform tasks between our respective sites, or to deliver products or services to you. This may include but is not limited to; releasing your credit card information to the card-issuing bank to confirm payment for services purchased on our App or Site, and releasing your address information to deliver appraisals and other services that you ordered.

Occasionally we may be required by law enforcement or judicial authorities to provide PII to the appropriate governmental authorities. In such cases, we will disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

Security

With our App, Services, and Site you can be assured that your personally identifiable information is secure, consistent with current industry standards. We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of your personally identifiable information. For example:

1. We work hard to ensure that the data we collect is reliable, accurate, complete and current. We encrypt personally identifiable information, in order to prevent unauthorized parties from viewing such information when it is transmitted to us. We also only keep collected information only for as long as reasonably necessary and use it only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements.
2. We limit access to personally identifiable information only to specific employees, professionals and agents who have a reasonable need to come into contact with your information. For example, we may provide members of our technical support team with limited access to your account in order to allow them to troubleshoot problems you may be having with the App or Site.
3. Finally, access by you to your PII is available through a password and unique customer ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone.

In order to most effectively serve you, credit card transactions and order fulfillment are handled by established third party banking institutions and processing agents (such as Stripe). They receive the information needed to verify and authorize your credit card or other payment information and to process your order.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this App or Site cannot be guaranteed.

Children’s Privacy

These Services do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.
